: Why doesn't Justice Thomas ask questions during oral arguments?
Clarence Thomas doesn't ask questions for several reasons. If you ever take the time to read his opinions, you will see that he is not an individual gifted with extreme intelligence. Also, he has no need to ask questions because he will follow the lead of his hero--Scalia--who definitely forgets his roots and where he came from right along with Thomas.
Indeed, Clarence Thomas is an embarrment not only to his own race--but also to the many Americans who fight for the civil rights that he and his ancestors continue to be denied in this country.
He probably couldn't explain tonight's unjust opinion issued on the presidential elections if he had to--let alone explain how the court justified having jurisdiction over a state issue—or denied American people the right to elect a president.. Thomas approved this opinion in which the Supreme Court has now granted itself the authority to override one of the few rights that Americans are supposed to have left--the right to vote and elect officials according to the people's choice--and according to the constitution. Many Supreme Court opinions clearly indicate that precedents are all too often set based on personal views of some of these justices as opposed to the law and the constitution. The intervention in the election is yet another example of this--and unfortunately--there are no checks and balances for this all too powerful government entity. The sad thing about Thomas is --he can't even rule based on his own "opinion" or personal view--let alone the law. So the better question is--How could he ask questions???
Finally--should Americans have to be subject to the individuals appointed to this all too powerful entity?? A lifetime appointment with no one to answer to?? Elect our president for us??That's the law of the land right now--we are stuck with Thomas and the likes for the duration unless the constitution is amended to reform this flaw in our system. And now--Bush, Jr.--the son of the ex-president involved in the contra affairs--will likely be appointing four more like Scalia and Thomas.
